The Counter-Terrorism and Security Act 2015, which received Royal Assent last week, has some network-related provisions among its various powers relating to terrorism. Section 21 adds further "relevant internet data" to the list of information that public telecommunications operators may be required to retain about the use of their networks and systems.

A long time ago, testing software was part of my job. To help with that I had an initial checklist of questions to pose to any new program: situations where I should check that it behaved as expected. Once it passed those basic checks I could get on to the more detailed testing specific to that particular program. With the Government apparently about to "fast-track" another piece of internet law, it seemed worth trying to draw up a similar checklist for legislation. Here’s a second draft:

I’ve made a Janet submission to the joint Parliamentary Committee considering the draft Communications Data Bill. It’s actually quite hard to predict what the effect of the Bill would be, as the Bill creates extremely wide powers for both the Home Secretary and Law Enforcement and the impact will depend on how those powers are used.

A first look at Part 1 of the Government’s draft Communications Data Bill seems to confirm predictions that it would represent a significant change for network operators.
